The Taxpayer Advocate Service (TAS) is an independent organization within the IRS. They ensure that every taxpayer is treated fairly and that you know and understand your rights. They help you if you have tax problems that you can’t resolve on your own. It has been a help to all of the "Do It Yourself" (DIY) types. But those days of "DIY" are over. 

 

TAS recently announced in its blog that it has been overwhelmed with assisting taxpayers who need their help.

 

“Our advocates have been handling unusually high levels of inventory (BOTH TAX DEBT & NUMBER OF TAXPAYERS) for the last year,” writes Erin Collins, the national taxpayer advocate, in a blog post. “The past two filing seasons have been particularly difficult. On top of dealing with personal, medical, and financial challenges brought on by COVID-19, taxpayers have struggled to get advice and answers from the IRS, and millions of refunds are still pending.”

 

TAS can’t fix problems itself. It can only work with the IRS to advocate for certain solutions. Consequently, the TAS can’t do its job if the IRS doesn’t do its job. Currently, both entities are too understaffed to do their jobs efficiently. According to Collins, taxpayers wait an average of 80 minutes when they call the TAS for help, and many encounters what she described as “courtesy disconnects”, in other words, they get hung upon.

 

For the past year, the tax professionals at Flat Fee Tax Relief have been advising everyone with tax debt, that we are in an opportune time to settle a tax debt with the IRS.

 

There are several main reasons for the problems being experienced by both the IRS and the Taxpayer Advocate Service (TAS).

 

TAS is expecting 253,000 cases this year which is an increase of over 50% compared to 2017. Adjusted for inflation, the budget to operate the TAS has fallen by 10% since 2017. As a result, the staff levels have decreased by the same amount, even though the workload has increased.

 

Due to IRS logjams, the IRS is taking longer to resolve tax debt problems. Consequently, TAS advocates are having to spend more time on each case. The Taxpayer Advocate Service, like the IRS, wants to close files. When you multiply that by 253,000, it’s easy to see the problem. TAS can prioritize taxpayers facing financial harm. However, it is now taking many months longer to provide the needed federal tax help. If you are facing an IRS levy on your paycheck, your bank account, and/or your Social Security, the Taxpayer Advocate Service won't be able to help you before real damage is done to you.

 

In addition to the TAS problems, the IRS is about to add 83,000 additional Agents to its staff. These additional agents are being placed aboard to go after "the super-rich" only. They will be going after the "low hanging fruit" and that is you.

 

Due to the deluge in tax debt and tax debtors, the IRS has been sending out a "Notice of Intent to Levy" to taxpayers with tax debt. They are hoping to collect money and close files with a "Notice to Levy." Once these notices are sent, they never need to be sent again. The IRS Automated Collection System can match up your job or bank account and then order a levy.

 

It is the opinion of our IRS problem solvers to use the volume of tax debtors against the IRS will be in your best interest. To be proactive will be your best friend. The IRS has enhanced its Fresh Start Program with the Taxpayer Relief Initiative.
